In Texas you must have your marriage license seventy-two (72) hours prior to the wedding ceremony. Active military personnel are exempt from the 72 hour waiting period.  Marriage Licenses are purchased from the County Clerk at the County Court House and are good for thirty (30) days from the date of purchase. You may purchase your Marriage License in any county and go to another county within the State of Texas to be married.

The Recording Process:
We sign and complete the Marriage License as the Wedding Officiant.  All Marriage Licenses are immediately sent to the County Clerk to be recorded the next business day following the wedding.  You do have the option of returning it to the courthouse yourselves if you are in a time crunch.  Once the Marriage License has been recorded by the County Clerk, the original Marriage License will then be mailed back to the address on the Marriage License that you provided when it was purchased.  Marriage Licenses are recorded in the county from which it was issued.  Not in the county that you live or the county that you had your wedding.  When you receive your Marriage License back depends upon the county that it was purchased from.  Large counties take longer to return the license, sometimes as long as 4-6 weeks.  Smaller counties issue fewer licenses and can process the license faster, sometimes as quick as 2-3 weeks.

"WHEN YOU GO TO THE COURTHOUSE ":
You will need proof of your identity and age. You may use your Texas Driver’s License or your Birth Certificate.
You will need parental consent if you are less than 18 years of age.
If you are from Out-of-State or do not have a Driver’s License you will need your Social Security Card and a photo I.D.
If you are from another Country and want to be married in the United States you will need to have your Passport.
You must appear together before the County Clerk to purchase your Marriage License (unless it's a marriage by proxy).

County Clerk Offices are only open Monday through Friday and are closed on weekends.
